          One thing I bet we all share with HMRC is that none of us wish we had ever encountered AVJ.

          If AVJ hadn't handed HMRC the Suo Motu users on a plate, and then conned them into thinking he could reel everyone else in, I doubt they would have sat on the scheme for as long as they did.

          Take AVJ (Suo Motu, ir35amnesty) out of the picture and I bet the scheme would have been closed with normal prospective legislation, and none of this mess would have ever happened.

          The actions of one man have simultaneously made HMRC look like a bunch of incompetent idiots, and blighted the lives of countless people.

          If only we'd all known what he was like at the time...

            I wonder if AVJ could be called to testify as to the precise nature of his relationship with senior officers of HMRC.

            I also wonder if AVJ has thought about selling his story to the papers...

                    ir35amnesty deal

                    Thanks to the person who contacted me with the details.

                    It was essentially the same as the offer that Suo Motu clients got ie.
                    • lower tax rate
                    • no NIC on trust income
                    • no interest or penalties

                    Incidentally, do you think it's conceivable that HMRC agreed to these concessions, which would have been negotiated late 2002, without understanding how the scheme worked?

                    That is to say, would they have offered such a settlement without full possession of all the facts?

                    I don't have many other experiences of dealing with HMRC. Are they in the habit of giving out deals willy-nilly?

                      I still find it incredible that MTM neglected to tell us that other scheme's using the similar tax planning arrangements had been forced to settle with the inland revenue and been offered a favorable deal to do so.

                      I certainly would not have stayed in the tax planning if I knew.

                      Guess I just answered my own question!!
