    Agency 'migration'

    Got a mail today from 'current' agent' stating that wef a past date in March(!) all contractors are being migrated to another agent at client's site.

    They've also omitted from the revised contract;

    reciprical termination clause
    not specified daily rate is exclusive of VAT
    stated a professional working day instead of the of 7 hour day currently in force
    etc

    ******* diabolical!
    I couldn't give two fornicators! Yes, really!

    Yeah that's crap that is.
    Do you have to sign? Is it end of if you don't?

      Probably. Thing is client wants to extend current contract by a further 6 months but client seems to be instigating the agency migration!

        hi BolshieBastard,

        Have they explained why are they shifting contractors to a new provider?

        In any case, legally, as the terms were changed, and even if the original agreement forced you to sign with subsequent providers, you do not have to sign anything.

        I advise you to go through the agreement and make a note of the amendments made to it.

        Simply make sure that:
        1) you make a formal reply (should you not, then your conduct may amount to acceptance),
        2) you tell them which clauses you are not happy with,
        3) you give them an explanation as to why you are not happy with these.
        4) and what change would you like to it.

        Should this not work then, you should tell them that you will have a discussion with the client. If they are a new provider with a new relationship with the client, the chances are they will make the changes.

          Previous client did that to me. Rather unfortunately it was a cost cutting excercise and the new agency went bust within the year.

            Hi Mardi. Thanks for this. Yes, I've mailed the agent and told them what's missing from the 'new' contract and that I want these missing bits put back in.

            I havent had chance to discuss with client as the first I found out that I was affected was last night and I dont work Fridays. Other spring contractors on site were told about 3 weeks ago but Im not through spring.

            I dont see how legally they can just revoke an existing contract and retrospectively (where have we seen that before!?) issue another one with changed conditions. I've asked for an explanation about this too.

            Agent hasnt got back to me yet so will wait and see.
