    Subcontracting work - do you ask the subcontractor Opt out of The EB Conduct code ?

    Basically , if my Limited Co passes a piece of work to a subcontractor , is my Limited better protected if I ask them to Opt Out of the Employment Business Conduct code ?

    The relationship between my Limited Co and the subcontractor is just that - I have a client and I am passing the piece of work.

    IIRC correctly the regs don't apply in this case (there's a specific exclusion?) so you can safely ignore it.

    Nothing wrong with you putting a "you must pay all your taxes, I'm not liable" clause in. Not sure if that would make any difference when push came to shove though...

      No - you are not an Employment Business registered with DBERR. You are engaging in a business-to-business transaction, not acting as an EB, so the regulations do not apply.

      Also, if it did apply, you can ask them to opt out, but you can't make them opt out anyway.
