Could you perhaps ask the question in the terms that Jane Kennedy answered the question - that means they must either answer it or make her look like a lier. There's an elephant wondering around here... -
ITV's tonight show
hi
anyone see ITV's "Tonight" show today? At the end they asked if anyone has experienced problems with HRMC, as they're running a 'piece' on them soon. (Showed clip of some dude who'd been incorrectly charged £12k tax.)
They're asking for people with similar experiences to contact them via itv.com/tonight.
Reckon this could be of any use?Comment

PAYE - Tax Code Change
Great work guys. DR and other please keep up great work.
My 3 x CN’s are now appealed by MP.
This will make laugh or cry….HMRC must be getting desperate.
Dear Warlord, (From HMRC)
I am writing to inform that your PAYE tax coding is being reduced by £350 a year - tax year 2009/2010, for the reason please phone us……blah blah
Apparently I am getting a benefit from my current full-time employee. And this was detailed on my P60, which is then detailed and explained in my Self Assessment form which MP did for me for 2007-2008.
So much for a Self Assessment form……
Yet another thing I will be appealing againstComment

Government's response to Treasury Committee
Thanks PlaneSailing. None of us had come across this.Originally posted by PlaneSailing View PostDR,
Before you write your letter it may be worth having a look at this:
http://www.publications.parliament.u.../689/68904.htm
Towards the bottom of the page the Government respond with their
timings. I'm still not sure why, if they knew about this in 2001, then why
not do something about it then!
In the light of this, I'm not sure there is much point me writing.Comment

According to MTM, HMRC made no reference to the "Padmore" legislation until last year. It is almost as if HMRC knew it did not catch the MTM scheme so didn't try to use it. Or HMRC were asleep.Originally posted by PlaneSailing View PostDR,

This was published after the committee had debated the clause - the committee had picked up that HMRC had know about the "problem" - but they did not know how far back HMRC knew people were using the scheme.Originally posted by DonkeyRhubarb View PostThanks PlaneSailing. I don't think it was possible for Parliament to change the clause by the time this report was printed. So while they have mentioned years, it was not done at a time that could have made a difference.
It's a con.There's an elephant wondering around here...Comment

Jane Kennedy did tell the Committee that HMRC had been aware of it since 2001 but what they weren't told was how many users HMRC had already put under enquiry or how its use had grown over the years. The impression given was that it suddenly lept in 2007 but if you look at the figures I got from MTM, this had been brewing for much longer:Originally posted by Toocan View PostThis was published after the committee had debated the clause - the committee had picked up that HMRC had know about the "problem" - but they did not know how far back HMRC knew people were using the scheme.

It's a con.
2003 - 200 users under enquiry
2004 - 350 users
2005 - 550 users
My guess is it was growing steadily year on year. When HMRC realised they'd backed themselves into a corner and couldn't win through litigation, they only had 2 remaining choices (1) right it off or (2) change the law retrospectively.
We all know that Parliament were conned about this but I haven't figured out how to prove it (yet).Comment
