    Holiday Pay for Contractors

    What is the definitive answer? It would appear that although I operate a Ltd company subject to IR35 that as per CAB web site I am a 'worker' and entitled to 4 weeks annual paid leave. I haven't pushed this yet...........but my agency seem to indicate that my company should pay me holiday pay, does anyone have a link or provide an answer?

    Assuming you are an employee of your Ltd Company, then the Ltd should pay your holiday pay. You’re not an employee of the agency are you?

      If you pay yourself £10k per annum that would include your holiday pay. Draw up a contract of employment with your employer that states your are entitled to 4 weeks holiday and all the stats days...........time to have word with your employer!

        Great idea, Jim. Take your client to an EAT and demand they pay you for sitting at home doing jack for four weeks of the year. In the meantime, we'll open a book on how long it is before your contract is terminated.

        Interesting point of order often misunderstood: no employer is required to give its staff bank holidays off and, if they do, there is no obligation to pay staff for those days. If they are paid, it can be counted as part of your four week entitlement.

          If you have your own company and draw up a contract you're obliged to pay the NMW.

          The working time regs mean you have 20 days holiday each year but can be obliged to work 6 days a week. In that circumstance if you break the entire weekend you've taken one day of your 20 days break.

          Xmas and New Year go off your 20 as well.

            Not quite, it's four weeks' worth of whatever a normal working week is for you (so if you work the equivalent of four days a week all year it's 16 days paid leave).
