Montp have a meeting scheduled with HMRC and then intend a judicial review....dont know the agenda for the meeting but suspect it will be along the lines of, your gonna play like this, were gonna play like this too, kind of stuff....Comment

I would love to know the answer to that. After all, bn66 was aimed at property developers?
I don't know about other Contractor schemes but I think PriceWaterhouseCoopers may be representing Property Developers.Comment

its this week, I dont know the agenda but maybe they are looking to broker a deal with HMRC pre judicial review.....Who knows....you could speculate that they will offer to cease to continue to operate IF HMRC revoke the retrospection to avoid a lengthy court battle that ultimately HMRC could lose anyway.....(THAT IS ME THINKING OUT LOUD I DONT KNOW IF THIS IS THE CASE SO DONT DEBATE IT PLEASE!)...who knows....
I dont have to tell people this who are in the scheme, they know but to all others MontP wont leave us high and dry, they have a financial incentive to win this and its a big one!Last edited by smalldog; 27 May 2008, 10:44.Comment

I have to say that if it wasn't for this thread I would be none the wiser on the BN66 issue, so thank you to all the informative posts and concerted effort in trying to address this.Comment

I had to laugh when I read smalldog's post. I don't think words like "justify" or "fair" are in HMRC's vocabulary
It seems their letter may be factually inaccurate. From my experience of my case they have a 100% failure rate at calculating it correctly anyway....
However, it was some years ago so the regime may have changed since then (certainly when I was charged the credit and debit interest were much closer to base rate).Comment

hi contract, yes Ive been in touch with them and so is from the horses mouth. Its sit tight time, I reckon we should get some formal comms in the next week or so (they didnt say that just my guess). I dont expect them to comm anything out to us until they have something to report, and I certainly wouldnt expect any comment from them on this board for obvious reasons....IMHO we have a pretty good chance of something going our way, maybe brokeraging a deal with HMRC, thats purely on the basis of reading the the commons transcript last week which showed the HMRC arguments looked initially weak on the basis that they should have shut it down sooner rather than allowing it to continue if it presented such a tax risk...Last edited by smalldog; 27 May 2008, 11:12.Comment
