we have a strategy that we believe will allow over 50% of persons such as you to walk away with no tax liability in months rather than years. You won’t hear this option from your scheme provider because it will be them who pay the tax.

Ha ha ha.. Why only 50%?

It was usthat submitted tax returns claiming relief, not Montp. We signed them. They may have given bad advice but I don't think there is much we can do about that.

The key word here is "we". They have not discussed with HMRC. I wonder how many have been stupid to go along with TW? No harm in speaking to them - but actually doing anything is quite different...

Very good question. It makes me feel like contacting them to find out! I must be strong - they will just bull**** !

          IR35 v BN66

          Hi

Am I correct in assuming that the total tax liability even when caught by BN66 is less than IR35 - taking interest out of the equation ?

          Thanks

these are people who would be made insolvent by the demand

incidentally, in my case I dont think the demand will cripple me, but I actually have no idea what I will owe, I was in it for 2 years, and havent received trust income since april 2003.

General question - has anyone yet just gone to hmrc and said, 'sorry, I was a bad boy/girl ; how much do I owe?' - and got a reply.

i am thinking of doing this cos I'm sick of the whole thing and, when all's said and done, we were taking the p*ss weren't we

I cant believe you said that. it was perfectly legal. remember that HMRC read this.

Can you afford a CTD? Use DR's formula as a guideline...

dont worry...I think its just Hector disguised as poppy01...hectors just trying to get us to admit to something that isnt true...its a tried and trusted police interview technique...make a statement thats sounds reasonable and then just wait for the suspect to drop him/herself in it...sorry, hector/poppy01 - its not going to work here...

everyone who was in the scheme knows that the scheme is 100% copper-bottom solid...thats why its taken hector over 5 years of total inactivity before he realised that the only way he could get his way was to steam-roller in a very dodgy bit of retrospective legislation...

so, no we weren't taking the p!ss, poppy01/hector...we were just interpreting your feebly written tax rules in a way that worked to our advantage, not yours...if you dont want that to happen, then go away and write the tax rules in a clear, concise and unambiguous way...

I personnally expect them to backdate it until Dec 2004 - when they initially warned tax avoidance scheme's that future scheme's would be backdated to that date. I think they will struggle to backdate before that but I am no expect and it seems that can do what they please.

I was in since 2001 till 2007, so stand to owe quite a lot. Went into this with my eyes open so I kept it in a safe place to pay back if neccessary.......

Sorry about that, feeling petty low at the moment.
Cant afford a CTD and to borrow would be pointless as I cant get anything better than the 8.5% hmrc will charge. I kinda want this to be over and done with, and have zero faith in Montpelier, judicial reviews or the ECHR, they are gunning for us and they'll get us..
