Intrestingly Montpellier beleive that the changes in BN66 do not affect the scheme anyway.

The first ammendment by the Lib Dems (132) to remove Subsection 4 was negated on division ie. they voted and the Government won.

The Conservatives then didn't bother calling the other 2 ammendments (134 & 135) presumably because it would have been a waste of time.

If you then read further down it says:

        Clause Agreed to.

In other words it has been passed "as is".

well what a waste of time all that was.

i have asked montpelier for their opinion as to how they will attack bn66.
if i dont get a satisfactory response i will be going with tim warr who reckons he can get my liability down to nil, due mainly to the fact the liability will bankrput me, i believe he may also be planning to attack the scheme promoters themselves for the outstanding balance...

why did anyone think this was going to get us anywhere????????

I don't know who you have been talking to but I think you have been misinformed. I am talking to people at the top and they are in no doubt that BN66 (Clause 55) affects the scheme.

It certainly seemed to be enough to change the scheme as from April 6th.

ok so on the assumption it gets royal approval mid july and becomes law then do we know what happens then, has HMRC explained how they will enforce? Is the next step court prior to mid july, or is court post it becoming law, what happened to the treasury committee's objections? Is there still time to get the bill changed or is that it now...

I thought there was a possibilty of a challenge under human rights act?

human rights act on what grounds? sounds a bit desparate to me....

                      Judicial Review

Montpelier are preparing a Judicial Review to challenge the legislation before the Bill receives royal ascent.

I am trying to get some details of what the JR will involve, timescales etc, and will post here as soon as I have more info.
