Im gonna be really P*ssed off if I have to sell one of my houses to pay HMRC if we lose!!! Wouldnt be so bad if this didnt happen to coincide with a bad housing market....

could always try suing Montp I guess if we lose, after all its their tax planning solution and if it doesnt actually work could we hold them liable?

Remember that alot of stuff happens you dont want to know about. A few wrong words and it could blow things apart. After all it relies on legislation interpretation.

At the moment the case looks more and more safe - lets keep it that way.

So far to me they seem to be doing a great job - shame they cant stop HMRC bullying people but that is something we all have to learn to deal with.

The discussions here have focussed on what we can do to fight the legislation eg. writing to MPs, submitting evidence to the treasury committee, liaising with PwC etc.

But you would be dead wrong to assume that Montpelier aren't doing anything, just because it is not visible to us at the moment.

Some of us have waited nearly 5 years to get to this point, and surely we can all hang in there for just a few weeks longer.

I cant see there being any decision this year or next. HMRC are in the wrong - but will fight and bully all the way.

HMRC obviously didn't fancy their chances in court, so it clearly was solid. I don't think anyone (probably including Montpelier) expected them to try and rewrite 20 year old legislation in their favour. If it's anyone we should be taking legal action against then it's the government. And guess what, that is exactly what Montpelier are preparing to do.
