    Umbrella company tricked me

    Hi Guys,

    I am not sure if anyone had faced this problem.

    I have issues with my health and had to close down my company as I cannot afford to spend time on it. So I went in the Umbrella route. I came to this guy through a friend of mine and he offered me an 80% and i was quite happy with the deal(I know i am stupid). He has told me there wouldnt be any tax issues and he would manage it through PAYE and expenses.

    6 months down the line he turns back and says he is not paying any tax and the 20% is his money and I have to pay taxes on the 80%. So I loose the 20% plus a higher bracket of 40% or more on the 80% so a total of 60% payout. I asked him to return all my money so that I can register self employed and pay all taxes myself in full (this way i loose only 40%). He asked me to fack off. Told him i would go to Inland Revenue but he says he cares a damn.

    His company had signed the contract on my behalf with the employment agent and i signed that as well so infact he is my umbrella. Other than that everthing was over the phone and no documents signed or anything. he says he is treating me as a subcontractor which is bullsh*t because I havent signed anything.

    He is refusing to give me any PAYE, payslips, p45 and I dont know what to do. Now I dont mind if he pays full PAYE on the 100% and I know even if I am loosing about 45% im still good to the taxman rather than loosing 20% to him + 40 odd %. Someone please suggest. Because there is no written agreement, can I ask him to put me all on PAYE for the whole amount of 100%? or can they charge what ever they want?

    I know it is stupid of me to let this happen, but ive been betrayed on goodwill. They know im sick and vulnerable and asking me to f**k off. Any suggestions will be greatly appreciated.
