Using a substitute

Hi,
I did a search but couldn't find any references to this.
I've decided that I'd like to use a substitute, a guy I know who works through an umbrella. Are there any example contracts/templates anywhere that I can use to set this up properly? Is it just the standard PCG one direct service provider-client agreement?
I'd hate to end up responsible for his tax or something worse.

Your best bet are the PCG template contracts, that you can download if you join. However, you need to use the contractor-agent template between you and the subcontractor that you are placing as a substitute (the contract between you and the client remains the same).

Provided that you use the template, then you will avoid liability for the subcontractors income tax/NI. However, you should keep in mind your obligations regarding payment (i.e. you may have to pay the subcontractor before you get paid by the client), and the different rights that apply if the subcontractor chooses to opt in or out of the agency regulations.

Hi,
I've grabbed the A05-01 Service provider-agency agreement contract. Am I right to assume that I'm the agency in this case and his umbrella is the service provider?
