Own limited company, being going for about 6 months.

A couple of direct contracts done so far, so money in the company account.

About to become a father in January. Not yet taken any money as salary from the company (just expenses).

Can I claim paternity leave?

I think it is about £98 per week or 90% of your weekly wage - whichever is the smallest.

It is actually £102.80 per week or 90% of average earnings if that is less than £100 per week.

Paternity Leave

Thanks for the replies so far, but my original question hasn't really been answered.

I realise that Paternity Leave is based on an earnings, but since I haven't drawn down any salary in the last 5 months or so, can I still claim it? If so, how?

I'm in a similar situation and had a think about it while sussing out the Mrs maternity entitlement. If you havent paid yourself any salary then I reckon you are not entitled to anything. If you had then your Ltd Co could of feasibly paid you paternity leave ( if you took time off ) and then reclaimed some of it from the government ( not sure how much ). In short I decided it wasnt worth the hastle as I'm sure my accountant wouldnt of done it for free. If you were actually having the baby then there is a few grand at stake and maybe its worthwhile !!?!?!?!?!?
