    Same Client New Role IR35 Perspective ??

    Have been at my current client 3 months of a 6 months contract as a data warehouse developer, in the contract I specified what my delieverables were specifically for the role.

    I have now finished the project but they want to keep on but in a different role (nothing to do with what I currently do) in the same department. I going to get my contract re-issued with an updated schedule to containt new job description. My concern though is that this change in role my reflect badly against from an IR35 angle as it could be seen as the client having control of what I do. The new role is not my usual work but the rate is too good to walk away from. Do you think it exposes me more to IR35 ?

    Yes - because if the old contract had really been for that one project then if you'd finished three months early you would still get paid. The other side of that coin is that if it takes 9 months instead of six then you'd lose out.

    It sounds to me as if you've got a service contract that runs for 6 months. Within that timeframe they can change the duties of employment.

    Can you insist they pay you for the project completed?

      Agree. Still, increased exposure to IR35 might be better than leaving and maybe not getting another contract for several months.

        I've now been 30 months at same company as a PM - running 6 projects in that time. I'm still ir35 free.
