    Any deGraaf users out there who received APNs?

    Our lawyers believe the APNs are invalid, and we're working to get them withdrawn like the Montpelier APNs.

    I'll post an update as soon as we have any further information.

        Withdrawal letters

        I received my withdrawal letter in January.
        I called HMRC a few times and there response
        even to them is unfair! whereby we can not
        have our CTDs reinstated but can only have a
        new one that will not include all the interest
        accumulated by the Robbers&Crooks whilst
        I had the CTD. So clearly their time machine
        can't go back in time and put our CTDs back!
        So, basically I was told that it's best to keep the
        money on account!
        Anyone got any ideas how to fight this?

          I got the same reply in letter form with a load of blather that the law saying as if the APN was never sent did not extend to reinstating the CTD properly but that it was "my choice" to use the CTD.

            This is disgraceful, even by HMRC standards.

            So they wrongly issue you APNs in the first place.

            And now they effectively strip away years of interest protection - all because of their own mistake.

            Which means that if they eventually win - they will charge you interest for years - all when the money was sitting in their own bank account without interruption.

            They could easily reinstate the original CTDs - they just won't

              Not quite. You get to keep the accrued interest protection if you leave the money, on account, with them. If you want the money back then you lose it.

              As you say, surely it can't be impossible to reinstate the CTDs.

                I bought a CTD back in 2008 and I haven't had to use it to pay an APN. Is there any advantage to me to convert the CTD to a payment on account or does it just mean it will be more difficult to get the money back when we win?

                  Holding a CTD has the same effect, of protecting against interest, as making a payment on account but has the advantage that you can access the money, at any time, if you need it.

                    APN repaid...

                    It took some hassling but I finally got a repayment for the incorrectly issued APN. I note that it didn't include any interest.

                    It's distinctly unlikely HMRC are going to make an allowance for my interest-owed based on how long they've had my APN money, should I be going back to them to ask for interest? If so at what rate? I had to arrange a draw-down from the mortgage to pay the APN so that would seem the "fair" rate to request. Has anyone else been through this?

                      A few people said they did get a tiny amount of interest added to their refund. Some have made claims for losses but haven't heard the outcome yet.
