HMRC Enquiry letters on Loans from EBT and other schemes

    No wonder they never give you their names on the letters!

    Maybe a stupid question, but is it worth going to your MP?

      Make your problem their problem. It's their job. They wanted this job.

        Please help regarding APN letter

        Hi,

        I am a new member of the forum, i have been following this forum but joined today, I got this APN letter from HMRC with huge figures. I am with AML, they said that they are dealing with the tax issue as they have Tax investigation officers from KPMG. What HMRC has done is completely wrong.

        Recently I got a letter from HMRC saying that the appeal/representation is not successfully and it has not met two conditions and HMRC said i need to pay the amount by end of Feb 28th, which i can't afford to pay.

        I told to AML that i can't pay but they are saying to speak to HMRC to make a time scale to pay, even though i stressed that i can't pay.

        AML said they are working on the case, not sure when they will get the result and told to start paying to avoid penalties.

        When I was browsing the internet, i came across the two tax specialists Tax Investigation And Tax Tribunal Help - Martyn F Arthur and Lynam tax consultants, they said that worked on this type of Tax issues and can help, but not sure about the end result.

        Also i came accross the WTT consulting, did anyone join this and how do they help as already AML has made a representation and appeal.

        Please friends please suggest what to do and how to go about. I am in a totally panic state.

          Join Big Group.
          You'll find plenty of fellow AML'ers there who'll get you up to speed. Don't count on AML to handle everything for you: they cannot.
          Big Group is operated by WTT Consulting but is really a cooperative of guys just like you.
          For your pressing needs (further APN representation, if it is possible), speak to Graham or Rhys at WTT. They offer tailored services independent of Big Group, if you need these.
          And don't panic: you are NOT alone!
          What HMRC is doing has a name: extortion (some call it racket). Don't panic and don't give in. Resist. Fight back.

            To date the only means of stopping HMRC from collecting tax due from an APN is to be part of a Judicial Review and claim hardship.

            For the AML scheme I suspect that boat has sailed so unless there is a means of being hauled on board at this stage (I'm not aware of any but then again I'm not a lawyer with expertise here) you are faced with managing the liability.

            We have managed in some cases to get stay in collection activity and in a couple of cases an agreement that no further action will be taken unless our client's circumstances improve. has to be said that DMB are reluctant to do this, but by enlisting the help of various parties, it has been done.

            Be under no illusion here. Failure to pay is likely to trigger penalty and collection action that can include some pretty extreme measures.

            I don't know Mr Arthur or Lynham and can't comment on what they do. For the sake of clarity, I am connected with WTT. Obviously I think we do the best job we can in the circumstances, but I recommend that you trawl these threads and perhaps PM a few people for their experiences before making a final decision because we all charge fees and you MUST be clear on what you expect and what you will get for your money.

              Received Just a letter too 06/02/16

              Webberg - he is right .... I also got a letter for 2011/12 out of the blue, demanding circa £32k payment within 30 days. No prior communication re looking into my 11/12 tax return.

              You would have had more than "just a letter". There must be an assessment or an APN in there somewhere. HMRC does not send letters demanding money without reason.

                Same for me and no previous letters. Out of the blue a demand for over £30k, showing online, waiting for the letter to arrive. From what I have heard it doesn't even show how hmrc arrives at the figure.
