Did you:

a) settle? this is irrevocable, and you can't appeal once you have settled

Or

b) make a payment on account? you won't be able to get the money back now but you may still be able to appeal with the possibility of getting it back later

I would ask HMRC what the status of this assessment is and whether you can still appeal it.

Am I too late to send appeal letter letter for old one ? I would like to contest for standard reasons

and ask for the money to be given back

I am not an accoutant and thus not an expert. So take what I say with hand full of salt not just a pinch. As far as I know you have accepted liability for 08/09 and if it was the same EBT, HMRC will/might press you to pay for other years as well. As for getting money back, I would image you should put in a appeal for that to ensure you don't run out of any time limits etc just in case but forget about getting anything back at least until HMRC closed the investigation of your EBT or EBT goes to court and wins. HMRC might not take the matters to court for years (with Ranger they kept investigating for 4 years) so money is definitely gone for a long time. You need a proper accountant and representation to deal with HMRC. I would advice don't even think about interacting with HMRC yourselves.

I did not appeal an initial charge for 08/09 (received feb 2013) & in fact made a payment towards this

Subsequently received additional charges for 9/10 & 11/12 - and send std edge appeal letter for them within 30 day limit

Am I too late to send appeal letter letter for old one ? I would like to contest for standard reasons

and ask for the money to be given back
