Enforcement of APN’s in New Zealand
Hi all,
I know this is an old thread, but hoping to get in touch with any New Zealander’s that we’re effected by the Loan Charge changes.
My case is slightly different, but would be great if someone could share info on the legal advice they’d received as would definitely apply to my current (ridiculous) situation.
Someone posted a while back about getting in contact so thought I’d get in touch!
Also, admin; can you please great access to PM?

I'm wondering if it's due to UK & NZ having a MARD? Have you had snail-mail from HMRC or do they have an old address? Did they also ask NZ for your income details, etc?

They said that HMRC had put in a request for my details from the IRD and they called me to check that they had the correct phone number and address. The lady said that she had a lot of people that HMRC had requested data for. I am guessing that other people can confirm this as they may have also been called.
I also said that I would rather she didn't hand over my details and she appologised and said that they had an agreement in place to share information.
Happy to meet you in Oneroa (Waiheke Island, Auckland) for a coffee at Wai if you want proof I'm not with HMRC!

I am in a similar position. NZ IRD called me a few weeks ago saying that HMRC had been in touch and wanted my details. I got a call last night form HMRC but didn't answer it - thought is was a spammer.
I have just joined the forum and don't have message rights yet so if there is any info you can share it would be much appreciated.
Cheers.

I'm a bit confused by the above two posts.
Let's say you owe £120k, and arrange a TTP over 10 years (120 months).
How much would you have to pay each month? Presumably more than £1000/month, if interest keeps accruing on the unpaid balance.
Is the interest recalculated each month as the debt reduces?
If interest rates go up, does your monthly payment go up?

For example.
You owe £10,000 for say 2014/15.
Due date is 31/1/16.
You agree to pay 31/10/18
You have interest on unpaid tax of £10,000 x 3% x (33/12) = £825.
Your total bill is £10,825.
You agree to pay £5,000 on 31/10/18 and then the balance over the following 24 months.
So on 1/11/18 you owe £5,825
If you pay £252.95 a month, you pay the above balance plus £245 and change in default interest.
Amount owed x ((annual interest + forward interest)x(months/12)/2)
annual interest is currently 3%
foward interest is currently 1% (this is additional interest HMRC charges because of increased risk!)
so in above example 5825x((3%+1%)x(24/12)/2) = 233 + 5825 = 6058
252.42 per month.
