    Enforcement of APN’s in New Zealand

    Hi all,

    I know this is an old thread, but hoping to get in touch with any New Zealander’s that we’re effected by the Loan Charge changes.

    My case is slightly different, but would be great if someone could share info on the legal advice they’d received as would definitely apply to my current (ridiculous) situation.

    Someone posted a while back about getting in contact so thought I’d get in touch!

    Once you have messaging rights send me your mobile number and I'll give you a buzz. I have some info, may or may not be helpful depending on your situation. Better to talk on the phone given that we're in the same country. And yes there are some dodgy accounts on here, that's why I reckon phone is better

    I have had snail mail at an old address. I don't know if they asked the IRD for my income. I expect so. I presume HMRC used MARD to get my details from the IRD.

    Just treading carefully as this forum does have snitches. I'm still surprised that you were contacted and that the other parties didn't communicate between themselves. It's almost akin to tipping off someone. I'm wondering if it's due to UK & NZ having a MARD? Have you had snail-mail from HMRC or do they have an old address?     Wow, I was not expecting that.
    They said that HMRC had put in a request for my details from the IRD and they called me to check that they had the correct phone number and address.     Why would NZ IRD bother telling you that HMRC wanted your details? And what details? Reading between the lines, I wouldn't be surprised if you are from HMRC.

    I am in a similar position. NZ IRD called me a few weeks ago saying that HMRC had been in touch and wanted my details. I got a call last night form HMRC but didn't answer it - thought is was a spammer.

    I'm a bit confused by the above two posts.

    Let's say you owe £120k, and arrange a TTP over 10 years (120 months).

    How much would you have to pay each month? Presumably more than £1000/month, if interest keeps accruing on the unpaid balance.

    Is the interest recalculated each month as the debt reduces?

    If interest rates go up, does your monthly payment go up?

    I believe the calculation is:-

    Amount owed x ((annual interest + forward interest)x(months/12)/2)

    annual interest is currently 3%
    foward interest is currently 1% (this is additional interest HMRC charges because of increased risk!)

    so in above example 5825x((3%+1%)x(24/12)/2) = 233 + 5825 = 6058

    252.42 per month.
