I can believe he wasn't drunk:

He had been drinking Budweiser beer but estimated his level of drunkenness as seven out of 10. He maintained he was in control of how he felt and his surroundings.

Mind you he's either got a low handle on alcohol consumption or he drank about 5 gallons.

So he did hit him!!!
