I think he is tulipting himself on point 3.. He phoned me saying he was facing a disciplinary for not having checked previosuly, although he did ask me for a photo copy of my passport which I provided. He now wants to come on site when I have my passport with me. I'll probably just agree to this as the agency have been pretty good in their dealings with me. By far the fastest payment of invoices of any agency I've dealt with.

Also, technically, it is illegal to ask for a copy of a passport. He would have to see the real thing.
1) You can send a company letter to him saying that your company has seen the passports of every employee and is willing to undertake the responsibility of ensuring all resources provided are eligible to work in the UK. This is fine under the legislation.
2) He would have to see the original, and he'd have to see it in your hand to actually comply with the regulations.
3) Thirdly by not getting an undertaking from your company or seeing your passport himself within a 'timely' manner (and 4 months isn't timely) he has already effectively broken the law. I suggest you shop him to the Dept of Employment and see him riggle out of that piece of horrendous record keeping.
