I signed a 9 month contract with my employer and its coming to an end.

I signed up through a consultancy agency but they're the worst. The actual worst.

I'm consistently chasing invoice payments and they never get back to me - a real 2 bit operation.

I've been offered a one year contract extension and I want to go direct.

Cut them out and sign on my own terms.

My contract though states that I can't do that for 6 months.

My question is how enforceable is this?

What might the ramifications be if I choose to push ahead solo and cut them out?

Any help will be greatly appreciated.

    Thanks,
You want to go direct, but does the client want to ?

It looks like you really are a noob when it comes to contracting, have you considered permiedom ? You will get a real employer and your pay check will be in your bank on the dot. Also, you get amazing perks like holidays, pension etc.

    Thanks,
    A few things: -
    1. They are not your employer. They are your client.
    2. The client is likely to be in as much trouble as you are if you go direct. Are they happy about that?
    3. What are the payment terms of the contract? Have they broken them?
    4. You should have started the thread in welcome/FAQs so we HAVE to be nice to you. As you did not, do you own a DFS sofa?

In summary, if the client has alot of sway with the agency you might be able to do it. And the agency will need paying off.

Keep looking for another role. Get one then you have the whip hand with the agent.

In the meantime, don't forget to lick the chutney spoon.

Just waiting for some "witty" mod to move this thread to Welcome/FAQs then give me infraction points. Apparently I only need another 15 to get a "Keep up at the back" wicking shirt for my next race....

    Thanks,

If the'yre late with payments, then it's arguable that they have breached the conditions of the contract.

It's not enforceable but the agency will remove you from their xmas card list.
