Getting legal advice on a Contract

It appears a complete lottery as to if you are deemed in or outside IR35 when looked at by the IR. I have read a few of the judgements and they all contradict each other. If you are working on a single client site in a 'normal' contractor setup ( ie. working for a client manager ) then it seems to me its very hard to argue you are outside IR35 regardless of what your contract says. I am deeming myself outside IR35, keeping my fingers crossed and making sure I have enough money tucked away to pay up if the time comes. I have been overseas for a good chunk of post IR35 so my bill won't be too horrific if it ever comes !

No.
You have to look at the actual working relationship (because the IR will).

For example, if you put in your contract that there will be no supervision from the customer but in reality they tell you what and how to do your work then obviously the working relationship is different from the contract. The IR looks at the acutal working conditions.

what happens if the contract given by the agency is no where near going to fall outside IR35 will they still try and change aspects of it to make it look like it is outside.

Basically can all contracts be edited to fall outside IR35 no matter what the agency ??

Agency sent me a draft contract at about 3pm. By lunchtime the next day Sarah Bauer had negotiated contract changes with the agency and had a new agreed draft for me to sign. Think it cost about 120 squid - money well spent.

You then get a detailed report on the contract detailing why the contract passes an IR35 test, going through each relevant clause in detail.
