    To clarify - if you did not opt out, in writing, before being introduced to the client, then you are opted IN. In this case, the agency must pay you for the time you worked.

    You have a contract with the agency, not the end client. If you have performed the work and it has been acknowledged you should get paid really. It is up to the agency to worry about getting their cash.

    I would make sure they have an invoice, if it isn't paid charge them interest and if still not paid get the debt collectors on them.

    Have a look at http://www.payontime.co.uk/ and people have recommended http://www.thomas-higgins.co.uk/ as a good route to getting your cash before (I haven't used them personally though).

    Agency wont pay

    Hi all,

    Im new to this contracting , but have had a bad situation happen lately.

    My agency has decided to hold back my last pay after the company I was providing services for/paying them went into receivership. Everyone I have spoken to say that I am within my rights to get paid by my agency as they take the risks.

    Is it in the law that they must pay me for the work I have done in this situation?
