    Talk to Aidan Healy, he specialises in this. You also will need to understand the Malaysia tax system to avoid being taxed locally.

    Firstly before creating such a company find out if the agency, who are based in the UK, are happy dealing with one for a UK tax payer.

    Hi,

    I am new to contracting after 7 years in a permie role. I'm going to a working in KL, Malaysia - but critically - billing my UK recruitment agency. I'll still be a UK tax resident (as I'm not leaving indefinitely, permanently or 'working abroad - as I'm billing my UK recruitment agency).

    My contract falls under IR35, and I've been scared off using the IOM solutions.

    So I've looked at creating an offshore company, but paying myself (and potentially wife) in dividends to the UK.

    But I'd be keen to understand whether I can legally create an offshore company (I'd be working in KL) and if anybody had any advice or could point me in the direction of somebody who could help - it'd be very much appreciated.
