To find out if you are inside or outside IR35 you need to review your working practices. By the sound of things you do not have enought knowledge to establish this for yourself so I'd recommend you get it independently reviewed. We are an accounting firm and have teamed up with an independent specialist and all new clients are getting a free review at the moment.

If you were contracting before April 2007 you were probably using a managed service company; this is no longer an option for you as they have been outlawed. You can either use an umbrella company who will pay you via PAYE or you can set up your own limited company which you will have to administer and for which you will need a company bank account. If your contract is inside IR35 you will still be taxed via PAYE, if your contract is outside IR35 you will be able to draw dividends from your company.

Hi everyone

Ive joined this forum seeking some advice. I Have recently been working on a perminant basis but before that i was a contract designer. I was a contractor with the same company for 2 years. I used Brookson services as i was adviced they were pretty good. Will i was with them i had to set up a buisness account "Brookson 12345" is the account name. This next week i have a interview for another contract. My first question is

1. With Brookson was i in a ubrella of brookson or as a limited company

2. Will I have to use Brookson for my new contract (if i get the contract)

Ive come to the conclusion i was a director of a limited company as Brookson told me how much tax i was to pay back in April.

So now i have to decide which accounts to use.
