    David Cameron is my MP!

    I have just written to him - basically stating the facts as displayed in the other letters sent, in my own words and my own opinions. I asked what, as a party, the Conservatives could, and would do, to support the JR and generally lobby against the Government in this.

    This is the third letter I have sent to him, the first he personally replied to (paper - wet ink signature), before the Committee stage,stating the Conservatives would oppose, the second after the vote he just sent an acknowledgement card. So *hopefully* he should be aware of this topic by now.

    I'll post his response - hopefully it'll be worth posting!

    Nice reply from Jeremy Corbyn MP

    Just got a reply from my Labour MP, Jeremy Corbyn.

    Appears to be very on-side. From my experience of writing to Mr Corbyn, I know he is one of the few MPs that does "walk the talk".

    He's written a letter to Yvette Cooper, Chief Secretary to the Treasury.
    He has also asked me if I want him to raise this issue in parliament and went so far as to say that he could take up my case with HMRC if I wanted.

    Re: Retrospective Legislation - Clause 55, Finance Bill 2008

    I would like to thank you for your letter dated 24th June 2008, and for raising the matter with Rt Hon Jane Kennedy MP, Financial Secretary to the Treasury. If possible, I would like to bring this to your attention once more.

    Now that the Finance Bill has passed into law, HMRC have begun issuing closure notices. Although the legislation was originally cited against property developers, the vast majority of people affected by it are, like myself, freelance workers. My enquiries indicates that as many as 2000 such individuals may be caught up in this.

    I can appreciate the government’s desire to clamp down on tax avoidance, and perhaps they even feel justified in making an example of people who use these arrangements. However, the majority of people affected by this particular legislation are not wealthy individuals. Although this will obviously impact me personally, I have taken steps to try and protect myself and my family. Many others are not able to afford this luxury. I am in contact with a group of people in the same predicament, and a substantial number are facing insolvency, repossession and family breakdown.

    Maybe, in hindsight, I was naïve to enter into such an arrangement but at the time (May 2001) I was advised by a leading Tax Counsel that it was a perfectly legal way to organise my affairs. HMRC first opened enquiries on my tax returns in November 2003. In numerous correspondence I received from HMRC over the past 5 years, they stated that it was their intention to litigate against my claim for double taxation relief but of course this never happened.

    My legal advisors have recommended that I appeal against the HMRC closure notice on the grounds that retrospective legislation infringes my human rights. They are also applying to the High Court for a Judicial Review. However, if their endeavours ultimately prove unsuccessful, the fallout and human cost of this could be disastrous for many families.

    I hope I can count on your continued support to oppose this retrospective legislation.
