Do qdos negotiate with the agency for you? IIRC that's a B&C USP but I could be wrong. And it's well worth paying for just to not have to listen to agents "well no-one has objected to the contract before".
Qdos negotiate the terms to reflect the working practices.
I have used them twice. They are very detail-savvy (as they should be), prompt and professional... ...and they gave good advice about nuances that I questioned. Heartily recommended.
Used them in the past, would definitely do again. They did a great job of negotiating terms with the glorified temping agency that I was forced to use.
regardless of what is in your contract if it does not accurately reflect the working practices and relationship it will be no defence if you go to an IR35 investigation.
I fully agree with you but IR35 is a 2 stage process. 1) you need to have a contract that is outside of IR35 and 2) you have to act outside of IR35 (which is your point). Some numpties on here dont do either or they just do #1.
All I was saying, in reference to B&C is that they are good at ensuring you are on the "straight and narrow" with respect to #1 - the rest is up to you!
wise words chef - an honest company who you can trust is worth its weight in gold - shame there are not more around.
However I have been led to believe that all though you pay any solictor or lawyer a fee for their advice you are still taking that advice at your own risk.
If their advice turns out to be bobbins you still carry the can! (I think)
I've said it before and i'll say it again. Im not a lawyer and don't claim to be one therefore when a legal contract is drawn up between myco and anotherco I like to think it has been setup and written with my interests at heart rather than the biased onesideness (is that a word?) that agencies have continually tried to push on myco.
I would say B&C, specifically Kate Cottrell have never been anything less than extremely prompt and professional and I would highly recommend them to all.

It would seem the days of temps hiding behing ltd companies and inaccurate contracts to avoid paying tax are numbered.
They must be doing something right as they are growing and have recently changed premises. It meant admin changes and now there are new procedures to get the review done but worth it.
They will also attend court if you are subjected to an IR35 enquiry on a contract they reviewed.
I dont live far away so always willing to help local businesses! :-)

You can have your contract reviewed until the cows come home - but if Hector says it's not worth the paper it's written on - you're stuffed.
