    I have managed to make them pay me on the old contract as I think they knew they were in breach of contract by not paying me. The problem was that they drew up the original contract before actually receiving there contract from the employer!! So they put in x amount of days whereas they actually should have put an actual end date..... stupid them for drawing up a contract before getting the details!!

    depends how aresy you want to get about it.

    You have a contract which you have worked to, and both parties have signed.
    That contract will state among other things the rate of pay and the terms of payment [ i.e. within 30 days of reciept of invoice & timesheet ].

    If they don't comply, they are in breach of said contract.

    Having said that do you really want to pi$$ them off ?

    I'd phone up explain the circumstances and say you sign the NEW contract but only on the ocndition that the payments due are made to you as if they had the contract NOW.

    by the way what was the difference between the end dates ?

    Changed My Contract!!

    Hi everyone,

    After a little bit of advice really. I have just started contracting and this is my second week on the contract. I got a call last night (1745) from my recruiter saying that a new contract has been sent out and I needed to sign it (they made an error on it with the end date as opposed to just the amount of days im contracted for). Anyways he phoned up and said they got all my time sheets and my invoices on the Friday and asked if I had signed and returned the other contract. It has been sent to my home address and im about 110miles away from there so I will look at it at the weekend. He then told me they cant pay me until it has been signed, and is this going to be a problem? (I get paid weekly), so of course I replied "Yes of course it is, how often do you work for free??".

    I have already signed and sent back the original contract, otherwise I would not have started working on the contract. Do you think that its acceptable that I continue working this contract or shall I just wait now and go home until the new contract is up and running!! I have expenses that I need to cover whilst down on this contract, so not getting paid will hamper me somewhat. Any advice is much appreciated.
