There was a consultation this year, as a result of which the government have stated that they will bring in legislation early next year to remove the obligation for single owner/sole employee companies to have EL insurance. For now it is still the law that such companies must have this insurance. However, if you don't have an employment contract but are just an officer of the company, it's a grey area (hasn't been tested in the courts as far as I know) and I wouldn't bust a gut to pay for insurance cover you can never collect on !

As for IR35 - that is only a method of tax calculation and has no bearing on your employment status as far as anything else is concerned. EL insurance is regulated by the HSE and the DWP and their definitions of employment are not the same as those of the Inland Revenue and the Treasury.

Am a single Director company with no employment contract with my ltd company, and operate outside of IR35.

Is it fair to assume I need not have Employers Liability insurance?

Hypothesizing now.....if a contract is caught under IR35 is my company then deemed an employer, so I then have to cough up for the insurance?
