Hi,

Ive got the opportuntity to do some IT work for my local animal rescure centre, obviously I will be doing it for free.

Just wondered though could I bill for it ie charging 0 amount and they are another client to help me from an IR35 perspective ?

If your contract doesn't specify hours and you are being paid a daily fee then I would be inclined to say it would help. After all, you could be working much longer days on the paid contract than the usual 8 hours max hourly rated contract,therefore making it harder for the work to fall into the camp of 'doing it in your own time.' No time is your own time, when you are in business on your own account. However, I think that not being paid for the work is a problem because it is voluntary and this work doesn't add to the profitability of your company. If you could turn it into a training exercise that could be turned to future profitability for the company then that could help more.

I doubt whether this work would seriously turn an IR35 inclusion contract into an IR35 exempt one unless the above criteria could be met and your contract was already deemed to be a definite a 'grey interpetation' contract for IR35 purposes. It certainly won't turn an apple into an orange.

IR35 = contract by contract basis so no.

It might look slightly better but unless you spend some serious time there in the day and not at night which hector could think was your own time not company time I would doubt it.
