Up to £10m of taxes avoided by 2,000 users of a scheme known as Liberty may not be recoverable, the Labour MP said, because in 30 cases HMRC failed to start inquiries into personal tax returns within the 12 month deadline.
I thought HMRC could take as long as they like if they had suspicions?
In Liberty, HMRC failed to identify 30 people who had done the planning until after the deadline for opening an enquiry. That's about 1.5% of the total participants in a scheme designed to be secretive and where "disclosure" was done in a way that was not easy to spot.
Once an enquiry is properly opened, HMRC can take their own sweet time in advancing it.
