Are we waiting today on the publication of the new legislation and if so, will this impact the IR35 online tool, which i notice is still sitting as BETA?

The BETA status is an indication of the project status not the policy status so I wouldn't expect it to be changing any time soon.
Digital government projects that fall within GDS guidance go from Discovery -> Alpha -> Beta -> Live. https://www.gov.uk/service-manual/agile-delivery has some information on what each one of these phases mean -
