    I sent the challenge letter as provided by edge and when I got a reply from HMRC acknowledging my challenge it stated that whilst I hadn't explicitly requested a postponement of the collection, it was inferred, and so they had instructed the collection to be postponed.
    No harm in explicitly requesting it though.

      Hi Azza,

      Just to be clear, I haven't received a demand for any payment. Merely a request for information regarding loans received, which I have now provided. Is this the template you were after ? My response simply directed HMRC to my P11D for that year, with a copy of my P11D enclosed.

      Obviously I haven't ruled out the posibility that I may receive a demand for payment in the future.

        Bronco - you've got the 2010/11 letter which was sent out asking for loan details. If you were with edge in 2008/09 I suspect that you'll be getting the demand letter at some point. This is the one you need to appeal against using the template letter provided by edge

            Another Edge casualty !

            As I opened the brown envelope on Saturday morning , I glanced at my Self Assessment form and notice an outstanding balance of XXXXXX, so rang HMRC imediatley to ask whats this for for 2008/09, they couldn't give me an answer as they told me the dept that dealt with it only is open Mon to Fri 9 to 5,.

            So I phone first thing on Mon Morn get transferred to a chap who was having difficulty getting his screen up complaining there in the middle of moving office and he basically told me this is cause of the EBT thing and you been with Edge blah blah blah, no mention in the post of a letter of discovery etc ...he said it must of got lost as we posted it 2 weeks ago so they will post another by next week and give me another 30 days.

            So now I got chase to make sure I get a letter so I can appeal !

              Hi bstar1, I was in a similar situation waiting for my letter, more because I live OS than HMRC incompetance.

              I got a copy of mine by contacting my accountant as Hector will usually send correspondance to your regisitered agent if you have one.

                Coverstaion with an ex Tax Inspector

                Hi Gang,

                Anyone get any sleep last night? ;-)

                So today I had a chat with my friends chairman, (a previous TAX inspector for HMRC – 30 or so Years) an old lefty if you know what I mean, but quite with the times.

                He’s in agreement that these schemes have been going since the 80’s but as we know HMRC decided to move the goal posts and re-change the rules and deem them fit to go back as long as they like.

                He also has said some people have already coughed up the amount, cos they just didn’t want the burden, some appealing and waiting for the big case outcomes.

                He thinks Rangers will lose the next appeal; because lower courts are more favourable to the one who’s getting XXXXed then the Higher Courts which are more favourable to HMRC, The lower court voted 2 to 1 in favour of Rangers, now HMRC have appealed pending the Higher Court

                He thinks even if we have to cough up we will still be liable for all interest even if we provide HMRC all the historic info and they want re-claw back from previous years which they have only highlighted now.
                His advice is to get tax representation, and appeal, as what most of us have done already, he says if it goes to first tier tribunal it’s not so expensive but cost are involved at this stage. He says you can wait till HMRC sort themselves out and wait naturally for Tribunal or you can force it upon ASAP them through your Tax Lawyer.

                I know it’s none the wiser really but our best bet is the Rangers thing on a wing and prayer, it’s really all bull as we’ve done nothing wrong and showed and paid all taxable income right from the off, just because the economy has gone tits up the Governments response = screw all the people who worked hard in the good years (lawfully / legally I add) and change the law to extract more random amounts of money & that should get as 1 bill rather than embracing the culture of enterprise.....XXXXckers.

                  Fighting Fund for Edge Emloyees

                  Any opinions on all Edge employees only past & present shelling out a sum in to a pot say anything from £500 to £1000, if we can take this to the top and pay for the services of someone who can win this for us, we could have a good amount if there was a 100 or so of us in it, Edge Consulting Employee’s V HMRC, let’s face it Edge is not going to do anything.

                    Obviously you friend has an opinion however many cases have gone against HMRC....and I trust that the actual points of law are what any judgement is based on, otherwise all discretionary trusts are in trouble, which affects thousands of other arrangements used by many wealth planners and tax specialists:-)

                      so there is hope!

                      I thank everyone who has posted on this forum and hope we can collectively have the resolve to see this through.
                      if UBS won their case that can only help.
                      I personally feel my human rights are being breached by this retrospective action by HMRC. We did nothing wrong. it was law at the time. If i drove down a street in the one direction yesterday that became a one way street tomorrow how the hell can it be fair that i am prosecuted retrospectively???

                      HMRC should drop these cases and concentrate on the idiots who carried on after the legistration changed and it was illegal.

                      The trouble is that HMRC won their appeal against montpelier which was a different arrangement to EBT but they are having to go to european court of human rights - similar to us what they did (double taxation laws with IOM) was law at the time but somehow HMRC won the appeal. its disgusting.

                      Thanks to Jimmy Car etc public opinion is against us - we avoided tax but we did so in a way which was legal at the the time -the average guy who is PAYE will not support us - I am sorry to say we are 1000's strong but in a minority. All we can hope i that the law see's sense and law at the time is applied.

                      To be honest going with Edge is the worst mistake of my life - like many of u i am an average family guy and if I have to pay the liability it is going to cost me my house and place an emotional burden on my family that I'd like to think we can deal with but but in reality I cannot contemplate - sorry love we need to sell the house because i did something which wasn't illegal but is now seen as illegal by HMRC?

                      I wonder if Edge will support us? Montpeiler did a really good job but lost their appeal, they took fees from us so they should support us all the way to court if human rights.

                      I feel like mine have been breached.....
