Hi all, just wanted to let you know my position and check if anyone else had received the same:

Letter from Local Compliance Personal & CGT Compliance acknowleding my letter of dispute/appeal.

The text says:

I note your appeal against the 2008/2009 assessment and you contentions in this respect. However, my view remains that the fuds you received are taxable - potentially under a number of alternative provisions, including employment income rules and specific anti avoidance legislation. We feel this applied, but will consider any further evidence you may wish to put about the income is not taxable. If you do wish us to consider further details at this time, could you please also confirm the full amount of sums you received as loans, if my original estimate is incorrect. If I do not hear further from you at this point your appeal will remain open. I will nevertheless continue to review the arrangements and will write to you again in the near future.


Has anyone else received a letter with this text?

Any advice on what I do - ignore?

Hi All,

I have been in contact with a reputable tax adviser and barrister who specialises in this area. As we are probably all aware this is very early days and it has been said numerous times on this forum that good independent advise is a must. It goes without saying that good advice doesn't come cheap, and should any litigation be required then the costs can quickly mount up (let's hope that's not required).

A number of people have intimated clearly that they would be inclined to join a group, and this appears a sensible approach to take and certainly worthy of investigation as to how this would work in practice.

The adviser has outlined how such a group undertaking would normally be managed, and provided indicative costs and timescales for all potential stages (including worse case scenarios).

The next step is to gauge genuine interest in forming a group.

There ideally needs to be a minimum of 25 to 30 people to even consider getting past the first post. Clearly the more people the better. If you are interested then I would be grateful if you can send me a PM. I will gauge interest over the next 4 weeks. If the numbers are not met then I won't pursue it any further and will notify respondents. If there is genuine interest then I'll move things forward in a more structured way.

There is no commitment at this point other than expressing an interest. We have to start somewhere!

Like everyone else I am very busy and organising this isn't my core way of making a living. So I must emphasise I would just like to get initial interest. I am sure you will want to ask questions at this point but it is just not feasible at this stage to start replying in detail to individuals. If there is sufficient traction I'll correspond on a group basis in order to minimise my admin time. I hope you understand.

Hammertime, Im at the same stage as yourself but have had no joy trying to get a response back from Michelle Booth. I have mailed and tried calling too but have had no luck reaching her.

Can anyone advise whether any further action is required from here or whether this can be ignored for now? Also will be signing up with Dandy to provide funding for a group representation if require in the future. Any advise or information would be much appreciated. Thanks

With regards to the 2008/09 letters I have received the following correspondance

The initial demand after which I sent in a letter of appeal (the standard one from Edge)

A response the same as Hammertimes above. Mine also said something that roughly translates that they are not chasing payment of the money until the appeal is resolved.

A statement showing how much was owed and how it broke down. This can be confusing if it arrives after your acknowledgement of appeal, but it is a timing issue (it should have arrived about the same time as your first letter).



If your correspondance with Hector is the same i.e. you have appealled and they have acknowledged it, your main options now are to

1. Prepare for the tribunal process, which means drop in here regularly, speak to professional advisors and/or look into the group options being organised by TheDandy (Edge specific) and Michael J Perry (General EBTs)
2. Pay the amount now with the understanding that it will be repaid to you if the appeal is won. I have no idea at all how viable or risky this option is, I have simply seen it mentioned in a post here. Speak to HMRC if you have questions
3. Agree to your liablity and pay the amount off - which defeats the purpose of appealing in the first place

I think most people hear are chosing option 1, but don't take this as advice. You need to make your own choices based on facts.
