BG is about negotiation and bringing to bear the strength of numbers and focusing upon common themes.
We do make representations against APN's. These are done on a bespoke basis and we have not and will not make a block representation as they are all to easy to reject en masse.
We appreciate that a JR is about challenging the principles upon which the APN rests. In other words challenging HMG policy and legislative authority and application of that policy and legislation by a Government agency. I'm not lawyer enough to understand the detail and chances of success. We based our position on JR on reviewing the history of JR challenges against HMRC and the success they have had.
There is nothing to prevent you being part of a JR AND making a bespoke representation. This is something we would recommend.
HMRC are of the view that in a JR, because they have agreed not to collect the amounts demanded due to hardship, that does not invalidate their ability to charge a penalty for non payment, even if at the due date, the matter is sub judice.
Again, I'm not lawyer enough to comment on that other to note that this position has itself been challenged.
BG has clients who used the Sanzar arrangement and where appropriate, representations have been made. We don't really have enough data as yet to measure the reaction but anecdotally I would say;
Representations rejected as not meeting the criteria - less than 1% of those we have responses for
Representations leading to reductions in APN - perhaps 20% of those we have responses for
Representations leading to withdrawal of APN - perhaps 10% of those we have responses for
Representations leading to increases in APN - perhaps 2% of this those we have responses for (leads to anew APN and new 90 day period)
So I think there is space for all and any representations and challenges and they should all be tried.Best Forum Adviser & Forum Personality of the Year 2018.

Double APN
we have received our letters informing us of the HMRC calculation, wild by any description! but, we are now being told that HMRC will issue APNs against the company AND against us as individuals for the same inflated amount. Is this even legal and does anyone else have this problem?

hi, i could do with some advice/opinions on my position please.
A member of the EBT scheme, APN sent and appeal rejected following recent letter from hmrc saying the amount is due for year 09/10 & 10/11 within 30 days.
My umbrella have responded with some instructions that I'd like to run by someone if they would be kind enough to do so over pm?
