            PENALTIES and other questions

            Penalties are going to be a fact of life for those involved in an HMRC enquiry or those who do not take corrective action in relation to a Follower Notice.

            With regard to bank statement requests by HMRC, this is a usual procedure and should be complied with unless there is a compelling reason not to do so. A bank summary could be produced instead detailing the matters that HMRC are interested in, but they may still require the original or copy statements.

            A Follower Notice can only be issued where there is an open appeal or enquiry for a non-DOTAS scheme. This has to be based on a final judicial ruling. HMRC might be expected to issue an APN at the same time.

              MJP like usual play with words and ensure without saying anything wrong get some scared and contact him.

              Penalties will happen only if u do wrong things like not paying APN in 90 days and want to go to court even after follower notice. Using FN should definitely lead to a JR as it is a penalty for asking a decision from court.

                Why is there no private group setup for AML users? It seems all the rest of the companies providing a tax efficient solution have Private groups with what sounds like favourable settlement terms? Did AML not have as many users as the rest?

                I am still not sure what to do.. do i write to HMRC and ask for a settlement figure before the 'opportunity' runs out on the 9th January or whatever date it is?

                i want to speak to a specialist who can negotiate a better settlement, but not sure who to go to or speak to...

                  you can't negotiate a better deal - the tax is the tax. HMRC are not allowed to negotiate the amount. You may be able to negotiate better Time To Pay.

                    Creating a private group takes somebody to step up to the plate and do something about it. It could be your scheme has no such inclined individuals.... Perhaps you are the one for your scheme?
