Sunday Solutions Anyone Else Having A Problem

    Partnership Accts

    My Partnership accounts that arrived last week from Bradbury (The Bad Guys!!), (I’m aware of five people that have also had accounts) these accounts have been checked by my new accountant (Nice Guys! Answer my calls!), we are now sorting my 08/09 tax return. The partnership accounts seem OK, perhaps not what I was expecting, but having spent several hours talking with my accountant(Nice Guys!) about the Partnership and the final accountants (My Partnership has now closed) I’m happier. In the covering letter it would seem Bradbury (Bad Guys!) have reduced staff numbers radically and have been unable to answer almost any correspondence, a decision I suspect a certain Mr Nyiri (Bad Guy!)now regrets, given that most of the posts on this forum at the embryonic stage, are a simple case of bad communication.
    Whilst I’m not an accountant (I work in media!!) my tax payable in Jan is going to be less than I thought, the percentage rate of return via, the rather stupidly named Partnership, is still higher than what I get from my current PAYE Umbrella (on that note: does anyone have any suggestions on what’s on offer in the market as my current Umbrella offers a ridiculously low return!!) So whilst I’ve paid Bradbury (Bad Guys!) according to the my accounts £743 and never spoken to anything other than a call centre or answer machine, I will today as instructed in the letter be going online to the Bradbury (Bad Guys!) website and approving my accounts (I’m doing it as I write this post) I will then be going to the nearest CHURCH get on my knees and pray that this be the end of this silly, annoying ridiculous affair.
    Cause and Effect: Had the HMRC not employed an arm of contractors, some smart HMRC Alex’s would not of realised that a single man Ltd Company gave us “Contractors” almost 80% returns on income ( I remember the days!!) the same “Alex’s” would then not issued the stupid IR35 legislation, and us legitimate “contractors” would not of been forced to find other efficient ways of working other than via a PAYE umbrella (where you get the luxury of paying both employers and employees NI, whilst taking home 65% of your income and receive no employee benefits!!) had we not been forced to find other working models we would of not joined the Partnership, had we not joined the Partnership we would not be talking about this ridiculous affair........... Perversely had I not joined the Partnership, I may now be fighting IR35 or enjoying an Umbrella.......!!!

      Bradbury and Co never released the partnership accounts for 07/08 - for most partners. Most people who did receive something for 07/08 were still in the partnerships at the time, so Bradbury had a stronger reason to keep them happy.

      Basically, what they did is (eventually) they submitted tax returns for 07/08 on behalf of individual partners. These tax returns were submitted late, as late as June this year, incurring lots of penalties. Often the tax returns were submitted without the individuals concerned fully agreeing with the figures. These returns were based on "partnership profits" that bore no semblance to reality, because they took into account ludicrously high "partnership costs". Those partnership costs were never justified, and were made up as far as I can tell.

      In all cases that I'm aware of, including my own, Bradbury asked people to approve their tax returns without providing details of the underlying numbers (i.e those imaginary partnership costs). We were coerced to approve those tax returns because if we did not they would not get submitted to HMRC, we would keep accruing penalties, and we would not get our tax provision back.

      In my case, my tax return for 07/08 was submitted. I never saw partnership accounts for 07/08 or 08/09. After 6 months of threats and eventually filing a claim through HMCS, they gave me back most of my tax provision (initially a very large sum), but they held on to about 3k-4k, which I've accepted I'll never see again.

      It is wrong to think that your 'tax provision' is sitting somewhere in a 'client account', waiting for you to get it back. There are no such 'client accounts'. Your money is not segregated. You'll be lucky if it is even in the partnership account. More probably is that they've moved it / spent it / done something else with it to finance whatever scam they are running, and you'll be very lucky indeed if you get any of it back.

        Sorry - off topic here. But was searching through google for anyone else in the Fougere Viljoen partnership and noted that MarthT had mentioned the partnership.
        MarthaT if you are still around please can you request private messaging and get hold of me. I am currently with a group of contractors who are taking legal steps to recover our money. I would like to see if you have any more info on the Fougere Viljoen partnership.

          After you approve your accounts, can you be sure you will actually get the retention funds released though?

                can anyone who has recieved their draft partnership papers say how they were recieved?

                  If they wanted someone to spell – they would hire an English teacher. I’m not an English Teacher, nor do I pretend to be. But what I am is someone with a proven track record in beating these guys and that’s a different story.

                  As for all the posts and PM’s I received asking for help to get your money back, I’m sorry I didn’t get back to you sooner, I was in the Middle East on business.

                  Unfortunately, at this moment in time I am working on another investigation and as a consequence am too busy to help.

                  Not only that, I am wondering if it would be cost effective for you to employ my services at this moment in time. I’ve done a little research for you and from what I can gather (next hint coming up) there’s a few things that could be done very cheaply without employing my services. Spending a few days/weeks doing the suggestions on my last post should give you a couple of leads which may prove productive. (At the very least it will save you a decent whack of money if i did get involved).
