I have received the same sort of request from HMRC for years 2011-12 and 2012-13, when I was with Darwin which became IQ Contracts. I have contacted CHS who advise to ignore the letters. I am starting to get worried as HMRC have so much power now and there does not seem to be any defence. I see that connected with WTT and Big Group. Simple question, is this an area that the Big Group can advise on and help understand my liability.Originally posted by webberg View PostI would suggest that HMRC has no authority here and if they think they do, then ask them to prove it.
Otherwise, supply what you are legally obliged to but otherwise remain polite and professional but refuse "requests" unless backed by statute.

Whilst I don't doubt that CHS will give the most appropriate advice. I would make the point that they also supported Sanzar users. They recommended settlement, regarded that as their final world and then ceased support.Originally posted by DotasScandal View PostYes.
CHS support all of the schemes from the same stable, one may wonder if their advice is strictly impartial.
I, like many others, have spoken to several experts. None have recommended settlement, all recommended pay the APN and wait.

Even if you go back and say "I don't know what to do and am getting help, please wait" that's fine.
HMRC does NOT send letters just for fun. They have a process driven by law and internal systems. the process is designed to extract tax from you. Ignoring the letters just means that the juggernaut arrives on your doorstep one morning with a nice brown envelope and a bloody big stick.

Hi, I have now contacted them by telephone and apologised that had not replied. To be honest they did not seem too worried and have given me until Nov 11th to reply with the information requested. This weekend plan to sign up to the Big Group, hopefully they will provide assistance on how I should reply. I have documentation from the scheme provider to say that not DOTAS and do not need to provide a P11D, not surprisingly the provider has gone. Therefore if I have followed the advice of scheme provider I should not receive penalities - is it my fault? . However these providers appear again under a different name, so what is the score, HMRC not interested in chasing them.Originally posted by webberg View PostNEVER IGNORE HMRC LETTERS

As you are personally responsible for your own tax affairs, HMRC will not let it wash that you just followed advice from your provider. They have sort of given you some leniency by extending the deadline to provide the information they requested. That is about as much sympathy you will get from HMRC !! Even if your provider is still around in some context or form, get independent, professional advice. Big Group is a good start and extremely good value for money in my opinion.Originally posted by bytetone View PostTherefore if I have followed the advice of scheme provider I should not receive penalities - is it my fault?STRENGTH - "A river cuts through rock not because of its power, but its persistence"Comment
