Did you get a refund?Originally posted by MarillionFan View PostI got shafted by easy hire some years back. I went through the online process, paid my money and a few weeks later I drove over to get it on the day. It was a nightmare place to find and in fact I was surprised to to find the van I was picking up wasn't Easy Hire but just a local company. We sat down, gave my details and then he said 'oh you've had 4 speeding fines in 7 years'.
'Yeah, and?'
'Well our policy states we don't rent to people who've totted up 12 points in a 7 year period' (or some bollocks, I forget now)
'WTF has that got to do with anything?'
'It's in our T&Cs on the website when you pay?'
So not only would they not give me the van I'd paid for, they wouldn't refund me either.
I try not to pay up front for stuff as it's a ******* rip off.Rhyddid i lofnod psychocandy!!!!Comment

Good news, yes, I paid with credit card. Bad news is its Santander who are complete bellends.Originally posted by Gentile View PostOne word: Chargeback. I trust you paid via Visa Debit or any major credit card? If there's a dispute, get your bank to process a refund through their Chargeback Guarantee Scheme. This places the onus on the entity that's messing you about to take you to Court to get 'their' money, if they genuinely believe they have a case. I've not had to do this often (twice in my life), but each time I have it's amazing how reluctant people that were extracting the urine and retaining my money are to take their case before a Court, where they know they will lose. Possession really is nine tenths of the law.
Funnily enough, I tried a chargeback recently or should I say a section 75 refund for something I bought from ebuyer (who think the sale of goods act doesnt apply to them) and santander managed to cock that up.
I thought chargback/section 75 wasnt that easy though and you had to convince the bank that you were right. Rather than the onus being on the supplier to get the money back off you.Rhyddid i lofnod psychocandy!!!!Comment

Some banks are better than others. Mine - First Direct - has been excellent. With regard to the onus being on you to prove your case, though: no, that's simply not the case. All you should have to do to obtain a refund is state that you dispute the payment; it's for the person that wants to take your money from you to make their case that they're entitled to it. Some banks, unfortunately, aren't clued up to this fact, and will try to take the least hassle (for them) route of asking you to sort it out between yourselves. If your bank is one of those that does this, though, I'd advise you to:Originally posted by psychocandy View PostGood news, yes, I paid with credit card. - Persist. Your bank will recognise their responsibilities under the Chargeback scheme eventually, if you politely insist the onus is on them to process the dispute you want to invoke.
- Change your bank to one that's more co-operative and customer-friendly.
