The child may have instigated the sexual relations but the law is there to prevent the abuse of position. Who's to say that actions by the teacher, intentional or not, led to the child becoming infatuated with the teacher who then, against all professional conduct guidelines, reciprocated that attraction.
Many girls (and boys) get infatuations with their teachers. The law is there to protect children from themselves and from teachers who's moral boundaries are not inline with their profession.
