To me it sounds like HMRC have no means of detecting these schemes so are desperate to get people to pay anything. Is that a fair summary?

I think the 10pc is a penalty on top of the tax+interest that is owed already.

Going after 100,000 people is going to cost alot of time and money, so they want to whittle it down to as few as possible.
