    I had my suspicions when the prosecution case was wrapped after a week. Far too quick for a fraud trial - either they had him banged to rights, or they simply had no case.

    Unfortunately it isn't. The burden of proof flips the other way - if you want to nail HMRC for criminal charges - WG will have to prove they were malicious

    Civil remediation (compensation) however - that's a different matter. HMRC will probably end up buying WGs next holiday home.

      The trial collapsed after all the non-HMRC witnesses had given evidence. Their evidence supported the defence rather than the prosecution.

      Next to take the stand were the HMRC officers. At this point the prosecution barrister announced that they had decided to offer no further evidence and asked the Judge to direct the jury to acquit both defendants.

      The judge remarked that if the prosecution had gone on to the bitter end it would have been bitter for them.

        And sadly, because of this, no one with any interest in HMRC's vendettas will ever know just how weak, contrived and a load of bovine excrement their 'evidence' really was. Its almost as if nothing happened. Yes, they may lick their wounds for a short time but once a twat, always a twat imo.

          WHS. It's disgraceful that they will not be held to account for the use of public money to fund the harassment of an individual. They should be exposed for the malicious, incompetent bully boys that they are. I hope WG goes after them, and it leads to the end of a few careers. They should pay with their jobs, without anyone having to take action against them. Anything less just shows how corrupt they are.

            and i hope he goes to the press and takes em to the F***in cleaners! its an utter disgrace. Some jumped up twat in HMRC that has a vendetta thinks its ok to harass and WASTE tax payers precious funds on a flawed legal case.

            We are continuously told how previous and important tax receipts are, really?!

              One thing that comes out of this debacle is HMRC cannot be trusted issuing APNs. They don't know their arse from their elbow.

                Of course, the other thing to come out is that this is a personal vendetta by HMRC against WG.
                The whole S58 stitch up and the resulting victims is just collateral damage.

                The damage that has been done to the lives of hard working families, who were trying to bring certainty into their tax affairs, is disgraceful.
                Sadly it isn't over. When the APN's start coming out (Christmas Eve?) then the true impact is likely to become graphically clear.
                I despair.

                      Let's hope they do, the quicker they are out the quicker they can be JR'd, does anyone believe hmrc have the required impact assessments done? That should be another 12 months, take us past the next election and we can have another go at getting the legislation retrospectively clarified
