        The rules apply to all tax agents, but the term 'tax agent' is extended and now includes anyone who gives advice for free, and so will hit charities, such as the Citizen's Advice Bureau, Tax Aid, and Chartered Institute of Taxation's (CIOT) Tax Help for Older People, and apply to other businesses outside the accounting and legal professions such as Radio and TV, newspapers, tax publishers, websites, and tax forums. The fine will be levied at individuals, and so a business could find that all its employees are fined too.

        Websites!!?? It's like 1984.

        So if I meet someone at the pub and casually mention they would save tax using an ISA, could I expect a £1,500 fine?

          Another one bites the dust....

          Hello All

          I haven't posted for a long time as I have been wrapping up a long investigation by Hector into my use of the type of schemes (and others) under discussion.

          The upshot is financial ruin. Despite massive amounts of pressure and negotiation the upshot is £100k in defense bills and £125k settlement. I could maybe handle it if I was allowed time to pay but Hector is making it clear that unless I can clear the amount in 3 - 6 months (!!) then they will make me bankrupt. I tried to remortgage but they said no due to the "uncertain nature of my employment" despite the fact that I have worked consistently for 10 years and have never missed a mortgage payment and I have run my credit cards up to their max trying to pay the accountants and lawyers but in the end I can't cover the settlement.

          I simply do not understand this but the approach is very aggressive. The lawyer looking after me says that they are getting ever more aggressive in their settlement positions so I am having to declare bankruptcy myself as I have no idea when they will press the button and I need to get the process underway and alleviate the stress on me and mine. I appreciate that BR creates another type of stress but a change is as good as a rest as they say!

          I am not posting this to say "oh woe is me" - I am posting it to indicate how things are moving over at Hector's house. I am lucky - I have an incredibly supportive wife but the stress is getting to all of us. I need to resolve this now.

          I wish everybody the very, very best of luck in their continuing battles with the darkside but for me, the fight is done. I am not risking ever going through this again so I will be ditching life as a contractor for now. We are being driven so hard into the dirt that I no longer want to continue the struggle and I resent being told that schemes that were (and in some cases still are) legal are considered by them to be illegal or at least questionable which seems to be enough. How long before the limited company starts to get hammered as "tax avoidance"?

          I will sit back in my newly impecunious state, remember the cars, houses and other pretty toys that I have owned and wonder why the people responsible for raising revenue for our embattled economy would do something this stupid to a high net worth individual.

            I sincerely hope you can salvage something and return to some normality.

              Pastalista, sorry to hear about your plight, I dont get why they wont agree to a settlement when it means over the longer term they get all the settlement, whereas bankruptcy will only realise what you have at that moment in time so might not realise as much money....why is that a sensible strategy from any kind of perspective??

              I hope if nothing else you can now start to move on as you have a level of inevitability.

                    Hi Pastalista

                    I am sure we all extend our sympathy to you in this difficult time.

                    One lesson that all the users of this forum can take from this is that we must all stick together to combat this agressive onslaught by HMRC.

                    Whilst we may have a short respite waiting for the legal process to take its course, lets be ready to join forces if the occasion ever arises.

                    United we stand a chance of standing up to them. On our own we are powerless.
