How convenient for them! So after spending upwards of 7 years trying to find a legal argument to counter the arrangement they somehow "discover" a "warning" that nobody including themselves knew existed up to that point.

It is something anybody who arranges their affairs to reduce their tax liability will have to bear in mind in the future (& the past) if HMRC win.

Just got a closure notice for year 07/08, passed it on to De-Graff now.

Interestingly, it came from Middlesbrough and from a Mrs B Kloed, who I have not seen mentioned before.

As others have said, why the feck are they sending out CN's when they should know full well the JR is underway?!?!
Politicians are wonderfull people, as long as they stay away from things they don't understand, like working for a living!

I suspect they would have tried to use Primarola's PBR statement as the "signal", even though this only applied to employees, if it were not for the fact that this would only have allowed them to backdate it to December 2004.

          Hi All,

1st timer, I received a note from HMRC in Middlesborough titled -
Section 9A TMA 1970 Notice basically advising that they are investigating one of my SA' s and that I may wish to make a payment on account. Don't really know what to do so I will take advice from MontP. I have read a the blurb on CTD's but can't get to grips with it - is it an account I can set up to for pay liabilities to HMRC and avoid the high interest charges at a later dat? I would appreciate any info. I currently have some of the monies to settle but would prefer to wait until we have more info regrading the JR?

          Regards

Hi, and welcome to the forum. Making a tax deposit (ctd) stops further interest accruing.

However, since HMRC are currently only charging 2.5% p.a. and the JR is only a few months away, I'm not sure it's worth bothering with a CTD. You may as well stick the money in the best savings account you can find, and then review the situation again in 6-9 months time.

                Welcome to the thread

How many years were you in the scheme? Are you still in it?

the 1970 is the standard nonsense : it just enables them to keep the case against you open. Though non-issueance has not stopped them in other cases as HMRC are happy to break the law.

CTS is indeed "an account I can set up to for pay liabilities to HMRC and avoid the high interest charges at a later dat?" It effectively stops the clock on interest. Downside is that when ewe beat HMRC you are not going to get much interest......

If you want to be kind you could say they are useless. The reality is bullying and intimidation.

                    Oborne in the Daily Mail

Mentions the Shout99 guy (ray pooley) in his article on retrospection.

Unfortunately, chose to use IR35 as his example, rather than BN66.

                    Oh well.
