        Back at the office now after listening to the first 1½ hours.
        Was a great turnout, the clerk said that in 'all his years' that was the first time they'd had to open the upstairs gallery because downstairs was full.

        I didn't get to hear the IR present their case so I'll let Santa deliver a more balanced view when they get a break.

              I think so. It was clear and comprehensive, and the judge seemed responsive to what was being discussed.

              I came out feeling marginally more positive than when I went in. Was a shame to miss the IR guy giving his evidence though.

                Our QC presented the facts clearly IMO. The judge comes across as very sharp and receptive to the facts that are being presented.

                  I turned up but there was a message on the door saying 'Court Full'. Managed to earwig from the entrance area - our guy was doing a good job of presenting. Didn't realise there was an upstairs gallery! The court next door to ours had some woman screaming the place down - interesting place to visit!

                    Hi all

                    Just a quick post from the court cafe.

                    Elvin speaking for Montpelier is 2/3rds of the way through his defense.

                    He put a very good case with reference in particular to HMRC knowing the scheme existed since 2001/2002.

                    He went through Huitsons SA returns and correspondence with HMRC to prove this.

                    Elvin also discredited the evidence from McDougall/Davey for HMRC.

                    He went on to quote from Lord Justice Gibson the 5 points that define a partner to a trust, in order to refute that Padmore applies.

                    Thats all for now. More updates to follow.
