    The whole thing is just a joke 85 hours (which i dispute) out of 600 should not be a reason to pay up, i really dont want to have to go through the whole legal process as it will take forever.

    Goes to show how exposed us contractors are

      This issue just keeps going, client are now denying that i am entitled to any funds, i know i am as does the agency but the client just seems to be moving from one excuse to another

        Out of interest, did the client give a different reason this time?

        Sounds like the agent is at least pretending to be sympathetic to your cause. I'm sure they want their cut of you 4 weeks almost as much as you want your pay.

        Have you spoken to Parasol yet to see how they can help in the dispute?

          The client keep citing different reasons and each time i argue that reason and they come up with another one, the agency know the agreement is there i know it and so does the client, they just keep coming up with different things.

          I have threatented them with a subject access request now as they have denied a lot of the emails and conversations.

          Parasol dont want any part of this any keep coming up with the same statement saying all we can do is raise invoices.

            In which case you have no choice but to sue them. AIUI you are their PAYE employee, and as such you have the rights of a PAYE employee, one of these is to be paid. You could raise a claim for illegal deduction of wages at an ET, you've got nothing to lose (except the relationship with Parasol).

            Though TBH you need proper legal advice as to the best way to proceed.

              The main thing here is that you should not give in. It may cost you some money to recover the outstanding debts but at the end of the day you HAVE to go through with this.

              Because if you pull out now they will only try it on with the next sap that comes along. However if you drag their arses over the coals they will think twice before trying this on again.

              Also, if you present them with a summons (either county court or higher) you may actually get some movement on your outstanding debts as they may prefer not to be dragged through court.

              Your next move should be to get some legal advice and to get those lawyers to send a letter to the "bad debter" as a first step. This may be enough to prompt payment.

                No way i am giving up on this its the principal of the thing apart from the money.

                Trying to hold out on the legal aspect as i would have to take action against the agency rather than the client, and strictly speaking its not there fault, so i dont want to p*ss them off at this stage, its all a bit of a balancing act.

                If the client carries on flatly refusing then i guess i will have to make a formal demand to the agency.
