    Personal service company certainly doesn't mean inside IR35 (otherwise nobody would have won their investigation). At worst the first question just helps HMRC narrow down the list of companies worth investigating for IR35, so maybe answering "no" would throw them off the scent. But if they did know by other means you'd be in much more trouble and certainly get investigated.

    Yes, No for me. I intend to be honest about it. Though for all I know the accountant has already done it.
    Will work inside IR35. Or for food.

            I will talk to my colleagues about the P35 Q6. This has come up in this week’s review.

              I put Yes, No (I can't vote in the poll for some reason... Mr Moderator!!)

              As others have indicated I think honesty is the best policy. An honest mistake is one thing but deliberately attempting to mislead is a no-no.

                  Where do you stand legally if you take the advice of your accountant. For previous years my P35 has been no/no for the questions so Im doing the same this year.

                    Mine too. I'm not sure if they would accept my instruction to put No/No, but then I didn't ask.

                    I'm also assuming then that Yes/No on the P35 means I should be consistent on the Self Assessment and fill the "income dervided from service company" bit?

                    Edit: Interesting to see that the Yes/No stats are catching up with No/No since I first polled.

                      Since the questions have been re-worded I'd imagine this might be occur a fair bit. Try asking the PCG helpline or QDOS for their opinion, although judging by Lewis's post above it sounds like they think it's a load of fuss about nothing.

                      I find this very surprising myself. Obviously it's important enough to get two separate postings on the QDOS Freelancer News site though...
