    I see no problem really moving from paying IR35 to not, within the same company. BUT - you may need to ensure that your future contracts and working conditions are a lot tighter to ensure that you really are outside of IR35.

    Changing from IR35 to not when you are doing the same role would be silly, though. Regardless of having a "safe" or "unsafe" contract - if you are still doing the role, then you are much more likely to be deemed to be IR35.

    Of course, you could try and claim that you were paying the tax unnecessarily and would like a refund

      I assumed that this is a common occurrence when people move from Umbrella to Ltd. (OK, not the same comapny but fairly similar). The Umbrella contract would have to be in IR35, and the contractor might re-look at it when they open a Ltd. Does this happen much, and is there a major difference between this and what the poster is suggesting?
