Since Singleton J ruled in Hartog v Colin & Shields in 1939, this has been the case. If you think it's wrong, then you could always wait to be sued and then fight it to the appeal court and / or higher. But no-one has done it successfully to overturn that case in 75 years so I don't think you'll be very successful.

You are legally required to pay back any overpayments as they were your employer.
However you can have some say over how you pay it back e.g. 5p a week for the next x amount of weeks.Comment
