It is not even US Supreme Court - which incidentally ruled that tomatoes are venetables (which they certainly are), but in the UK tomato for some reason is a fruit. -

A tomtato is a fruit. Might not be a desert kind of fruit, but it's a fruit none the less. If I'm in a restauraunt with a nice lady, my wife will probably be asking some tough questions later in which case the genus to which the tomato belongs will be irrelevent.
