Anyone used Begbies Traynor (AKA realbusinessrescue.co.uk) for liquidation?

Our contracting business has to go into liquidation and we have been speaking with the above liquidators (called Insolvency Practitioners north of the border). Can't seem to find much about them online that doesn't originate with them...they are a huge company but have a local office. I like...

Time capped contract - ir35 flag?

Due to ongoing cuts in oil industry me and around 100 other contractors at a large oil Co have been issued with contract revisions which state that we are not allowed to bill for more than 80 hours in a fortnight. Nothing else has changed. Wondered how this would be viewed from 'S,D,C'...

front page of yesterday's telegraph --PSC loop hole being closed

Yes saw that. Was surprised no comments on here already. Would love to hear what advisors and those in the know think will happen next. If nothing else it will be interesting seeing how it is applied for the public sector so we can take a view as PSCs in commercial world. Always something to...

    confused by t&'s latest announcement

Yes but will we Ltd working with an agency have to now demonstrate outside IR35 or just carry on as normal? Maybe it's just me and you're all direct?..... See quote from article t will apply****automatically,****meaning contractors will be ‘SDC’ unless shown otherwise because the government...

    confused by t&'s latest announcement

I have... It is still not clear whether everyone working for thru umbrella OR agency will be assumed to be under SD or C unless they can prove they should opt out. That's the worrying bit as many of us have said when pushed Client Co will bottle it.

    confused by t&'s latest announcement

[HMT’s David] Gauke didn’t pull any surprises out of the bag,” says ex-tax official Carolyn Walsh. “[But] a one or two-month cap…may still be a possibility if, that is; it wasn't a ruse.” Nevertheless, from April 6th 2016, legislation will*prohibit tax relief on Travel and Subsistence expenses...

Agency Legislation and SD or C

I'm not making light of anything. I just can't see how clients can be forced to agree that they exercise S D or C if they don't and never have. My clients have always, without exception, retained MyCo on the basis of a contract which expressly states they will not SD or C how I work, I...

Agency Legislation and SD or C

I've been reading up on the Agency Legislation and have made sure that my contracts always opt out of it. It strikes me that if the Govt reiew of IR35 follows suit then it would be a simple case of adding an opt out clause? We are highly skilled oil and gas contractors running a 50 50 split...

"restricted covenant" might stop me going direct to client?

Firstly, I'm in oil and gas, so please no talk of "just walk" or "tell them to stick it" :) Been working through agency for 2 years with Client. I've not been happy with the agency and in particular the fact they will not let me see any part of their contract with the end client. Because of...

IR35 and Rate cuts.....who's a disguised employee now?!

Working on the adage it's an ill wind....having had two rate cuts thrust upon MyCo in last 6 months with no negotiation or right of reply, I have been looking for an upside :) Surely it would be hard to argue my contract was inside IR35 when a similar "paycut" would not be forced on employees...

Any OIL AND GAS contractors want to comment on IR35 review from thst perspective?

Given recent rate cuts and other horrors due to oil price rout, how do you think the IR35 review might affect our industry? How do you think the potential for the end client to have to get involved in deeming our contracts inside or outside will go down? We really don't need any more woes...

    Discussion document on IR35 published

Surely the Govt would look to the existing IR35 rules enforced atm when contracting thru a PSC to public sector client? If that is the case then anyone with a genuinely non IR35 contract has nothing to fear? Yes we will need to routinely pay for reviews (which I do anyway) and possibly the...

    Discussion document on IR35 published

Surely clients would be more likely to ensure contracts were outwith IR35? Surely clients would be more likely to ensure contracts were outwith IR35? I appreciate doom and gloom and general hating on the Taxman is de rigueur on here (and in my contracting life in general) HOWEVER...wouldn't it...

Agency refusing to show me their end client contract for IR35 review purposes

Good idea, thanks I will show them the Statement and ask for a compromise letter. I've had an email today saying basically they are satisfied it is compliant so I am already some way towards showing diligence on my part.

Govt IR35 review...better to be direct to client now rather than through an Agency

Not too happy with my agency arrangement tonight so got me thinking.... Many people here have commented on a separate thread that the current Govt review of IR35 may well lead to clients just saying basically "you're all inside IR35 from now on" rather than deal with the bother of sussing out...
